Great Canadian Hotels Contest - Rules & Regulations
1. To Enter: NO PURCHASE NECESSARY. Complete the online ballot form OR submit a video. One ballet or video entry per household. All entries must be received on or before 12 am PST September 5th 2011 for the Wake Up to Canada Grand Prize. SilverBirch Hotels & Resorts LP [the "Sponsor"], will not be responsible for entries lost, delayed, incomplete or misdirected. Entries will become the sole property of Sponsor and by entering, you consent to Sponsor and its parents, affiliates and agencies, adding your name to receive future promotional offers, and using your name for advertising, publicity or any other purposes whatsoever, as determined by Sponsor in its sole discretion, without compensation and with or without attribution to you, as Sponsor elects.
2. Eligibility: Contest is open to residents of Canada (except Quebec), who have reached the age of majority in their province or territory of residence. You are not eligible if you are an employee, representative, dealer or agent of Sponsor, its parent or affiliated companies, prize suppliers, advertising or promotion agencies, the independent judging organization or a member of the immediate family (defined as parents, children, siblings or spouse, regardless of where they reside) or household of any of the above persons. By entering, you agree to abide by these rules and all decisions of Sponsor and independent contest organization, which are final in all matters relating to this sweepstakes. To be eligible, winner( or family members) must not have won a prize from SilverBirch Hotels & Resorts in the past 12 months.
3. The Grand Prize Draw: A random drawing will be made on or around September 15th 2011 for the Grand Prize, from among all eligible entries received. The Video contest: The winning video entry will be chosen by a panel of judges at the SilverBirch Hotels & Resorts corporate office. There must be a minimum entry of 25 videos submitted for the additional contest prize to be awarded.
Selected entrant will be notified by mail or telephone. To win, a selected entrant must first correctly answer, without assistance of any kind, whether mechanical or otherwise, a mathematical, skill-testing question, to be administered by telephone at a mutually convenient time, or by mail. If reasonable efforts to contact a selected entrant and administer the skill-testing question are not successful by September 30th, 2011 the selected entrant will be disqualified. Selected entrant on behalf of his/her family (the entrant must be the parent or legal guardian of the children) will be required to sign and return, by the date stipulated in the documents, a Declaration of Eligibility and Liability and Publicity Release. The selected entrant, by the acceptance of the prize, confirms compliance with these rules and releases Sponsor, its parent and affiliated companies, prize suppliers, advertising and promotion agencies, the independent judging organization and all of their respective officers, directors, employees, representatives, successors and assigns from any and all liability, claims, or actions of any kind whatsoever for injuries, damages or losses to person or property which may be sustained in connection with receipt, ownership, use or misuse of the prize. By accepting the prize, the selected entrant and guest consent to the use of their name, address and/or photograph in any publicity carried out by or for Sponsor, without further compensation.
4. Grand Prize: There is one (1) Grand Prize available to be won and one secondary prize for video entries. The Grand Prize includes: thirty minute phone consultation with interior designer, high-quality Serta mattress and box spring (King, Queen or Double), headboard (Queen only), sheets, mattress pad, duvet, pillows and decorative bed scarf or accent pillows, dresser, two side tables, two lamps, 37” flat screen TV, coordinating artwork (framed picture), designer selected paint colors and Home Depot gift card to purchase the paint, all freight and delivery charges. Prize does NOT include painting of the room. The secondary prize consists of 5 night gift certificate for any SilverBirch Hotels & Resorts property. All prizes must be accepted within six months of notification. Prize is non-transferable and must be accepted as awarded, without substitution. Winner must take delivery of prize notification by registered mail. Sponsor reserves the right, at its sole discretion, to substitute a prize with another prize of equivalent or greater value if necessary for any reason. Chances of winning will depend on the number of eligible entries received. The Grand Prize is valued at $10,000 CDN. The secondary prize is valued at: $1000 CDN.
5. General: Sponsor reserves the right to cancel, suspend or modify this sweepstakes, in whole or in part and without notice, if any factor interferes with its proper conduct as contemplated by these rules. Sweepstakes is subject to all applicable laws. Limit: one prize per household.

Great Canadian Hotels YouTube Contest - Rules & Regulations
The contest is open to entrants are registered users (“Registered Users”) of the YouTube website located at http://www.youtube.com (including all mirror, derivative sites and/or local domain versions thereof, as applicable) (collectively, the “YouTube Site”). To become a Registered User of the YouTube Site, individuals must register for an account and agree to the YouTube Site’s “Terms of Service” set forth on the YouTube Site applicable to their local jurisdiction (“Terms of Service”). There is no fee or charge to become a Registered User. Sponsor reserves the right to verify an individual’s eligibility to participate. For the avoidance of doubt, the Contest is open to individuals only. Corporate or other entities or groups are not eligible to participate.
Techincal and creative requirements:
- Entry must be submitted in a format and file size accepted by YouTube.
- Create an original video expressing or showing why you deserve a bedroom makeover
- Language: English dialogue is allowed
- Running time: Maximum one (1) minute and (twenty) 20 seconds. Entries longer than one (1) minute and (twenty) 20 seconds are subject to disqualification in the Sponsor’s and Contest Administrator’s sole discretion.
Entry Terms:
By entering, Entrants agree to comply with YouTube’s Terms of Service, inclusive of its Community Guidelines (www.youtube.com/t/community_guidelines) and Privacy Policy (www.youtube.com/t/privacy), all of which are incorporated by reference into these Official Rules. Any Entry/Entrant information collected during the Contest shall be used only in a manner consistent with the consent given by Entrants at the time of entry and for the administration of the Contest as noted in these Official Rules (specifically including YouTube’s Privacy Policies referred to above and in Section 18 below).
Entries may only be submitted by a single Registered User. Group Entries will not be accepted (e.g., although different individuals might have taken part in the making of an Entry, and more than one (1) individual may appear in the Entry, only one (1) individual may be considered to have produced and submitted the Entry.) By entering, regardless of eligible country of entry, each Entrant represents and warrants that he or she has obtained all of the rights, licenses, and permissions in writing from any person (or parent/legal guardian if person is a minor) who may have helped create or who may appear in the Entry and for any material or elements that are not owned by the Entrant, and/or which are subject to the rights of third parties prior to the submission of the Entry; that his or her Entry conforms to these Official Rules, and that the Entry:
- is the original work of the Entrant;
- has not previously been submitted in any competition and has not won an award or prize of any kind;
- does not contain any use of the names, likenesses, photographs, or other identifying elements, in whole or in part, of any person, living, or dead without permission (proof of which in all cases must be provided to the Contest Entities upon request in a form satisfactory to Contest Entities);
- does not include trademarks, logos, or copyrighted material not owned by Entrant or material that is used without permission (including but not limited to company names, photographs, motion picture or television program clips or audio clips, works of art, or images published on or in websites, television, movies, or other media) or that otherwise infringes or violates the rights of any third party (including but not limited to, copyrights, trademarks, patents, trade secrets, logos, contract and licensing rights, rights of publicity or privacy, moral rights (i.e., “droit morale”), or any other intellectual property rights);
- except as set forth above, the content of the Entry is not subject to any third party agreement(s), and the Contest Entities will not be required to pay or incur any sums to obtain further permissions of any person or entity as a result of its use or exploitation of the idea or video or rights therein or portions, modified versions or derivative works thereof as contemplated in these Official Rules;
- does not defame, misrepresent, or contain disparaging remarks or any other content which could adversely affect the name, reputation, or goodwill of the Contest Entities or any other individuals and/or entities, the determination of which shall remain in the sole discretion of Sponsor;
- does not contain pornographic or sexual content, hateful content of any kind (including without limitation racism, sexism, etc.), content which promotes violence or harm to another living creature, or any other offensive, obscene or inappropriate content, the determination of which shall remain in the sole discretion of Sponsor;
- does not include threats of any kind or that intimidate, harass, or bully anyone, or invade the privacy of any person, the determination of which shall remain in the sole discretion of Sponsor;
- does not violate any applicable federal, local, state, provincial, national or international law or include any content that would encourage or provide instructions for a criminal offense;
- complies with any required permits or similar regulations required by local authorities or property owners and that all required permissions have been obtained (including, but not limited to, permits for filming location) and is documented sufficiently such that Entrant can show proof of such permissions upon request from the Contest Entities; and
- does not feature, refer to, or mention any competing brands of the Contest Entities.
Sponsor reserves the right to request proof of any permission to use the Entry in a form acceptable to Sponsor from any Entrant at any time. Failure to provide such proof may, if requested, render Entry null and void. By submitting an Entry, Entrant warrants and represents that he/she and any persons appearing or who are identifiable in the Entry consent to the submission and use of the Entry in the Contest and to its use as otherwise set forth herein. Entries will not be acknowledged or returned. Sponsor may prohibit an Entrant form participating in the Contest if it determines, in its sole discretion, that such Entrant is attempting to undermine the legitimate operation of the Contest by cheating, deception or any other unfair playing practices indenting to annoy, abuse, threaten, undermine or harass any other Entrants, users, or Sponsor representatives, or has breached these Official Rules.
Technical Limitation of Liability: To the extent permitted by applicable law, neither the Contest Entities nor any of their respective parents, subsidiaries, affiliates, advertising and promotion agencies, legal and financial advisors, any and all companies associated with this Contest nor any of their respective officers, directors, shareholders, agents, licensees, licensors and employees, nor any Internet access providers (collectively “Released Parties”) (except where due to the negligence, breach of these Official Rules or other default of a Released Party) are responsible for incorrect or inaccurate entry of information, human error, technical malfunction, lost/delayed data transmission, omission, interruption, deletion, defect, line failure of any telephone, computer or other network, computer equipment, software or any combination thereof, inability to access the Contest Site or the YouTube Site, for problems uploading any Entries or downloading any Contest-related materials from the Contest Site, or for late Entries not received within the stipulated date and time, lost, damaged, misdirected, incorrect, incomplete, delayed, garbled, stolen or inaccurate Entries or for any other problems or errors related to the Contest.
The Contest Administrator reserves the right to review all Entries received during the Video Submission Period and to only post Entries on the Contest Site that conform to these Official Rules, as determined by the Contest Administrator in its sole discretion (“Eligible Entries”). Entries that do not comply with these Official Rules as determined by the Contest Administrator, in its sole discretion, will be subject to disqualification from the Contest and removal from the Contest Site. The Contest Entities reserve the right to not post or to take down any Entry from the Contest Site at any time, for whatever reason, including subsequent determination that an Entry does not comply with these Official Rules. Released Parties are not responsible for any unauthorized use of Entries by third parties.
